Riley’s Rescue of Brevard Waiver of Release & Liability

The Volunteer will support RROB by engaging in RROB events, community outreach, dog/animal rescue, intake, marketing, advertisement, transportation, grooming, cleanup, fundraising, vetting of application references, and support leading up to, but not inclusive of dog/animal adoption or foster (the "Volunteer Activities"). The Volunteer understands that Volunteer Activities may involve working in unconventional circumstances at unconventional times to secure temperamental, frightened, neglected, or animals at large which is inherently dangerous and could result in injury. This Agreement does not cover the ownership transfer associated with adoption or animal foster. The parties agree to execute this document electronically.

The Volunteer hereby freely, voluntarily, and without duress executes this Release under the following terms:

1.  RELEASE and WAIVER OF LIABILITY.  Volunteer does hereby release and forever discharge and hold harmless RROB and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, that arise or may hereafter arise from the Volunteer Activities with RROB. Volunteer understands that this release discharges RROB from any liability or claim that Volunteer may have against RROB with respect to any bodily injury, personal injury, illness, death, or property damage that may result from the Volunteer Activities with RROB, whether caused by the negligence of RROB or its officers, directors, employees, or agents, or otherwise.  Volunteer understands that RROB does not assume any responsibility for or obligation to provide financial or other assistance, including but not limited to medical, health, or disability insurance in the event of injury or illness.  

2.  MEDICAL TREATMENT.  Volunteer does hereby release and forever discharge RROB from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with Volunteer Activities with RROB.

3.  ASSUMPTION OF RISK.  Volunteer understands that the Volunteer Activities may involve work that may be hazardous, including, but not limited to, working in unconventional circumstance at unconventional times to secure frightened, neglected, or animals at large and transportation to and from the work sites. Any RROB requisite standards of practice training issued to guide Volunteer in conduct of Volunteer Activities will be acknowledged in writing or in electronic format. Volunteer hereby expressly and specifically assumes the risk of injury or harm while conducting the Volunteer Activities, and releases RROB from all liability for injury, illness, death, or property damage resulting from the Volunteer Activities.

4.  INSURANCE. Volunteer understands that, except as otherwise agreed to in writing by RROB, RROB does not carry or maintain health, medical, or disability insurance coverage for any Volunteer. Each Volunteer is expected and encouraged to obtain his or her own medical or health insurance coverage.

5.  PHOTOGRAPHIC RELEASE.
Volunteer hereby grant and conveys unto RROB all right, title, and interest in any and all photographic images and video or audio recordings made by RROB during the conduct of any Volunteer Activities with RROB, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.

6.  ANIMAL ABUSE.  Volunteer affirms s/he/they/them have never been charged with animal abuse and never have been sanctioned or reprimanded by any animal rescue group or shelter for mistreatment of animals. Volunteer understands that Volunteer Activities may involve animals of unknown temperament and human retaliation of any kind is unacceptable.

7.  CONDUCT OF RROB ACTIVITIES.  Volunteer understands that all RROB rules, regulations, and policies exist for the protection of self and others.  Volunteer will conduct all RROB activities in accordance with established RROB rules, regulations, and policies or standards of practice.

8.  CHOICE OF LAW AND FORUM.  Volunteer expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Florida, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Florida.  Volunteer also agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.  Volunteer irrevocably and unconditionally agrees that s/he/they/them will not commence any action, litigation, or proceeding of any kind whatsoever against any other party in any way arising from or relating to this Agreement and all contemplated transactions, including, but not limited to, contract, equity, tort, fraud, and statutory claims, in any forum other than in Brevard County, Florida. Volunteer and RROB irrevocably and unconditionally submit to the exclusive jurisdiction of such courts. Volunteer and RROB agree that a final judgment in any such action, litigation, or proceeding is conclusive and may be enforced in other jurisdictions by suit on the judgment or in any other manner provided by law.

9.  ATTORNEY FEES AND COSTS. The Parties agree that if there is a dispute stemming from the Volunteer Activities or this Release by either Party and enforcement of said Release is required in a court of law, that the prevailing Party shall be entitled to an award of their reasonable attorneys’ fees and costs, for all proceedings including paralegal fees and any appeal, incurred.

10. CONCLUSION OF ACTIVITIES.  At the conclusion of the Volunteer Activities, the Volunteer will promptly return all RROB supplies, equipment, records, money, and other items.

Submission of this Agreement indicates that I have read, understand, and agree to the following:

A. I will keep all information concerning other volunteers, donors, adoptive families and anyone having business with RROB confidential at all times.

B. I will attend all required training sessions and work in accordance with the RROB standards of practice.

C. I will treat all animals, volunteers and staff with respect and I will work as a team member.
